摘要:Performance reporting in sunshine regulation is subjected to disclosure biases, because agents may game the regulation or encounter difficulties in complying. These biases limit the appraisal of the impact of sunshine regulation on performance. We investigate the behavioral causes of such disclosure biases by focusing on transaction cost economizing and opportunism. We provide an original methodology to take into account information asymmetries in principal-agent relationships. We focus on wat...

摘要:This article puts forward an analytical framework for understanding administrative justice. It does so by reading a leading approach, Jerry Mashaw's administrative justice models, in conjunction with the pragmatic sociology of Luc Boltanski and Laurent Thevenot, and their orders of worth framework. This provides an enhanced framework, which, while remaining consistent with Mashaw, offers additional insights and is particularly suitable for analyzing decisionmaking environments in the modern co...

摘要:This article revisits Majone's famous argument about accountability in the regulatory state in reference to the European Union's (EU) Economic and Monetary Union. We show that the EU has entered the stage of a para-regulatory state marked by increasing EU regulation in areas linked to core state powers. Despite the redistributive and politicized nature of these policy areas, the EU's para-regulatory state has continued to rely on its regulatory model of accountability, focused on decisionmakin...

摘要:Developing countries increasingly participate in transgovernmental networks of global regulatory governance, but they do so in different ways. This article aims to provide an explanation for this variation for two of the major emerging powers in the world economy, Brazil and China, in their transition toward more active players in the global competition regime. Distinguishing between bilateral and multilateral transgovernmental networks and examining the domestic factors conditioning the trans...

摘要:We offer a series of reflective insights about the state and direction of studies related to the politics of regulation. Notably we argue that the field is characterized by persisting divisions between Americanists and Europeanists. Largely focused on the actions taken by political principals, the former regularly report a substantial politicization of regulatory behavior. Reflecting on recent developments in US politics however, we show that political influence could be overestimated in the U...

摘要:Many countries adhere to the Organisation for Economic Co-operation and Development creed that innovation is good for the economy. Experiments are often used to intentionally create space for innovation. Decisions allowing experiments result in temporary legal enclaves for a few, excluding many others. Therefore, they come with risks. The aim of this article is to provide a set of guidelines that help improve the legal resilience of experimentation policies, so they are better able to withstan...

摘要:When addressing complex societal problems, public regulation is increasingly complemented by private regulation. Extant literature has provided valuable insights into the effectiveness of such complex governance structures, with most empirical studies focusing on how public regulation influences private regulation. Conversely, the impact of private on public regulation is less well studied. Here, we investigate this impact with a focus on technological change as possible mechanism. Based on a ...

摘要:As part of the better regulation agenda, the European Commission created a semi-independent institution, the Regulatory Scrutiny Board, to monitor the preparation of policy proposals. The position of this Board is potentially wide-ranging. A proposal that is not given the green light by it cannot proceed in the Commission's internal decisionmaking process. But so far, the Board has only received scant scholarly attention. We provide a comprehensive analysis of the impact of the Regulatory Scru...

摘要:Rising middle powers play increasingly active international roles, yet so far we lack systematic analyses of their aspirations and impact on global economic governance. This paper addresses this gap. I argue that the role that rising middle powers assume in global economic governance depends on the degree of alignment of their regulatory preferences with those of established powers, and on the strength of their regulatory institutions. If their preferences are aligned and they develop high reg...

摘要:Scholars have recently shown renewed interest in the study of party-interest group ties. According to previous studies, traditional ties between parties and organized interest are a matter of the past. Globalization, deindustrialization, and neoliberalism have posed serious challenges to their survival. Recent contributions suggest that, while these ties are indeed weaker than before, they have not disappeared. How do parties and groups protect their ties? This paper attempts to provide a part...
