摘要:This special issue examines the consequences of the ongoing power transition in the world economy for global regulatory regimes, especially the variation in rising powers' transition from rule-takers to rule-makers in global markets. This introductory article presents the analytical framework for better understanding those consequences, the Power Transition Theory of Global Economic Governance (PTT-GEG), which extends the scope of traditional power transition theory to conflict and cooperation...

摘要:The UK Financial Conduct Authority has developed and implemented policies targeting individuals for regulatory non-compliance in the post-2008 crisis period. This article develops a tripartite framework that differentiates between individual-firm, regulator-individual, and regulator-firm interactions to capture the complexity of these enforcement proceedings. Drawing on interviews with stakeholders, administrative decisionmaking observations, and documentary analysis, it outlines the process o...

摘要:This article frames whistleblowers as regulatory intermediaries who provide a response to the problem posed by the fragmentation of knowledge in a complex society and market economy. I identify two ways in which whistleblowers become regulatory intermediaries: The first is by remedying informational asymmetries between the regulator and the target (instrumental approach). Both in the United States and in the European Union, whistleblowers are protected on the basis of the value of the disclose...

摘要:Recent scholarship on transnational business governance has begun to examine public-private interactions and the active role of governments. We make two key contributions that integrate and expand this literature. First, in juxtaposition to functionalist accounts, we foreground the fundamentally political and often contentious character of these interactions. As private transnational governance schemes and standards hit the ground, private-public interactions, we argue, are embedded in nationa...

摘要:This article extends the study of regulatory compliance motivations from traditional regulatory settings to a government-sponsored voluntary one. We argue that the rationale(s) which motivate participants to engage a voluntary program likely shape which motivations drive them toward (or away from) program compliance. Our study examines the possible influence of program participation rationales alongside that of regulatory agents' enforcement styles and strategies. Leveraging a national survey ...

摘要:Regulators and other governors rely on intermediaries to set and implement policies and to regulate targets. Existing literatures focus heavily on intermediaries of a single type - Opportunists, motivated solely by self-interest. But intermediaries can also be motivated by different types of loyalty: to leaders (Vassals), to policies (Zealots), or to institutions (Mandarins). While all three types of loyalists are resistant to the traditional problems of opportunism (slacking and capture), eac...

摘要:Pharmacogenetic tests provide genetic data to tailor drug treatment and were widely predicted to be one of the first fruits of the Human Genome Project. In the mid-2000s, the US Food and Drugs Administration (FDA) became an advocate for pharmacogenetic testing, but its efforts to build a market for this new technology brought the agency into dispute with other regulatory actors over the type of evidence needed for the adoption of pharmacogenetic testing, in particular the importance of randomi...

摘要:Based on the inductive analysis of two parallel cases of private environmental governance - private, market-driven fisheries governance and private, market-driven governance for electricity decarbonization - this paper uncovers a trigger for positive public policy spillovers from private environmental governance. It identifies circumstances that prompt groups of business actors working as private regulators to also take on a role as public policy advocates and supporters, revealing a potential...

摘要:Street-level interpretation and enforcement are critical to defining the meaning of law. To understand street-level regulatory decisions, prior studies have highlighted internal office conditions, neglecting the influence that peer offices can have. This study examines the role of horizontal inter-office interaction among frontline offices and illustrates how and under what conditions it shapes the meaning of law. Drawing on qualitative and quantitative data on Japan's Soil Contamination Count...

摘要:Does tariff liberalization cause regulatory chill by putting downward pressure on health, safety, and environmental standards? Or does it cause a race to the top as governments seek to use standards as nontariff barriers to trade? There remains remarkably little empirical evidence to answer these long-debated questions. We seek to address this lack by analyzing annual country-by-industry data on notifications of changes in sanitary and phytosanitary standards by world trade organization member...
