摘要：Over the past two decades, the political landscapes over which regional human rights courts exercise jurisdiction have changed dramatically, signaling the need for a new model of supranational human rights litigation based on the dynamics of social change in countries now Subject to these courts. Focusing primarily on the Inter-American Court of Human Rights, this article recommends procedural and jurisprudential modifications to enhance the domestic impact of the Court's work in the Americas.

摘要：Human rights have traditionally been seen as vertical, establishing rights for individuals and obligations for states. Recent proposals seek to reorient human rights law horizontally, imposing obligations directly on corporations and other private actors. These proposals fail to appreciate the horizontal effects of existing human rights law, and risk undermining its structure and opening the door to new restrictions on human rights.

摘要：This article draws on the theory of deliberative democracy to examine the legitimacy of the quasi-legislative and quasi-judicial acts of the UN Security Council in creating the counterterrorism regimes under Resolutions 1267, 1373, and 1540, whose implementation requires broad international support.
